GTC – Ticketing and Shop
1. Validity of the General Terms and Conditions
- 1.1 These General Terms and Conditions (GTC) regulate the sale and delivery of all present and future orders for products and services as well as booking tickets (hereinafter collectively referred to as “the Services”) that the Museen der Stadt Wien (hereafter referred to as “Wien Museum”) provides to its clients at its locations or as part of its internet platform https://www.wienmuseum.at/ and https://www.shop.wienmuseum.at. These GTC apply to all customers (hereinafter referred to as “the Contractual Partners”)..
- 1.2 Terms and conditions of the Contractual Partners shall not apply. Deviating or additional agreements with natural persons or legal entities that are outside the scope of the Austrian Consumer Protection Act (“KSchG”) must be negotiated individually with the museum.
I. Online (Ticketing) shop
2. Services and terms of payment
- 2.1 The products offered by the Wien Museum at https://www.wienmuseum.at or https://www.shop.wienmuseum.at represent a non-binding invitation from the Wien Museum to its Contractual Partners to make a binding offer for the offered goods. Upon ordering in the online shop via clicking the button “Order with obligation to pay,” Contractual Partners are making such a binding offer. A contract between the Contractual Partners and the Wien Museum is only then concluded when the Wien Museum has accepted this offer with a separate confirmation.
- 2.2 After selecting the desired items and entering the contact details in the order form or ordering via the e-mail form, the Contractual Partners will receive a confirmation e-mail. By placing an order, the Contractual Partners accept the GTC of the Wien Museum. The purchase contract concludes once the ordered items have been sent.
- 2.3 Shipping costs are charged according to weight, volume, and the location of the address to which the order is delivered. The order is sent by post together with the invoice. Delivery deadlines always apply from the moment at which the contract is concluded..
- 2.4 The Wien Museum reserves the right to withdraw from the contract in the event that itself has not been supplied correctly or properly with respective items. If the goods are unavailable or only partly available, the Contractual Partners will be informed immediately and will be reimbursed.
3. Retention of ownership
- 3.1 The Wien Museum retains ownership of all products that it delivers until all outstanding debts arising from the business relationship with the Contractual Partners have been paid. This retention of ownership continues to apply even if the Contractual Partners resell the delivered products to a third party. Any claims resulting from this resale to third parties are hereby already assigned to the Wien Museum by the Contractual Partners. Any resulting costs shall be borne by the Contractual Partners.
4. Right of cancellation
- 4.1 Contractual Partners who are consumers have the right to cancel the contract within 14 days of sending the goods without giving a reason. In order to assert this right, they must complete a form and return this, together with the goods, to the Wien Museum. The Contractual Partners bear the costs for return shipping. - 4.2 The Wien Museum is registered with the alternative dispute resolution services “Online Dispute Resolution” (https://webgate.ec.europa.eu/odr) and “Internetombudsman” (www.ombudsmann.at). If Contractual Partners are consumers, they have the opportunity to use an impartial arbitration service on the above-mentioned platforms as a means of extrajudicial resolution.

II. Purchasing tickets
5. Booking tickets
- 5.1 In order to book entry tickets or tickets for events and guided tours/education programs via the booking system, Contractual Partners must visit the website and click on the link to the online shop, which redirects them to the booking system. In the booking system, Contractual Partners are guided through the booking steps and related options (e.g., number of tickets, date, etc.). By clicking on the button “Order with obligation to pay,” Contractual Partners make a binding offer to conclude a purchase contract with the Wien Museum.
- 5.2 In the case of discounts or reduced prices, Contractual Partners must correctly enter the information required for the discount in the online form. There is no automatic right to receive a discount. Upon arriving at the location, Contractual Partners must provide proof that entitles them to claim this discount.
- 5.3 Contractual Partners agree that the Wien Museum may send them invoices by e-mail.
6. Validity of tickets and late arrival of Contractual Partners
- 6.1 The ticket is only valid for the date and the time for which it is issued. It cannot be redeemed at any other time.
- 6.2 The ticket must be shown in printed or digital form before entering the location. If Contractual Partners are unable to present a ticket, they have no right to enter. It is the responsibility of the Contractual Partners to ensure that they are carrying a legible ticket. Illegible tickets will not be accepted.
- 6.3 If contractual partners have made unauthorized use of a discount when purchasing the ticket and do not meet the requirements for the discount, the ticket is invalid.
7. Cancellation of events and guided tours/education programs
- 7.1 The Wien Museum reserves the right to cancel guided tours/education programs on certain dates. In the event of such a cancellation, the cost will be refunded to the Contractual Partners and the ticket for the canceled date will become invalid. The cancellation will be made by e-mail.
- 7.2 The refund will be made using the same payment method that the Contractual Partners used when booking.
8. Right of cancellation (Right of withdrawal)
- 8.1 The Wien Museum offers online tickets for a certain date and a defined time. This is considered a leisure event within a specified period of time. Hence, in accordance with § 18 para 1 Z 10 of the Austrian Act on Distant and Non-face-to-face Transactions (“Fern- und Auswärtsgeschäfte-Gesetz”), there is no right to cancel/withdraw.
III. Common provisions
9. Payment terms
- 9.1 The prices stated for all Services include legally applicable taxes but exclude any packaging and shipping costs for online orders.
- 9.2 The total costs are displayed before the submission of the contractual declaration.
- 9.3 Online payment can be made via the proposed payment methods and concludes the order or online booking process.
- 9.4 In person payment takes place in cash or by card payment (debit or credit card payment)
- 9.5 Invoices are to be paid without discount before the deadline given on the invoice. In the event of a culpable late payment, the rate of default interest amounts to 4% per year. The Wien Museum has the right to assert a claim against Contractual Partners for damages that they have caused or for which they have accrued, particularly the necessary costs of any appropriate, extrajudicial debt recovery or collection measures, provided that these are proportionate to the claim being made..
10. Vouchers
- 10.1 The Wien Museum offers vouchers for sale. These vouchers can be redeemed for the purchase of services defined by these GTC under point 1.1.
- 10.2 Vouchers can be redeemed either online or in person.
11. Compensation and guarantees
- 11.1 The legal compensation and guarantee provisions shall apply. If the customer qualifies as entrepreneur (running a business), he shall be subject to the commercial obligation to inspect and give notice of defects within the meaning of § 377 Austrian Corporate Code (“UGB”). If he fails to comply with these notification obligations, the goods shall be deemed approved.
12. Museum Rules
- 12.1 The Museum Rules of the Wien Museum are part of these GTC and become part of the agreement upon the successful conclusion of a contract.
- 12.2 The Museum Rules govern, in particular, the rules of behaviour for visitors to all the locations of the Wien Museum. Museum staff is permitted to expel people from the museum if they infringe the Museum Rules. In such cases, the cost of the ticket will not be reimbursed.
- 12.3 The Museum Rules are accessible in the entrance areas of all Wien Museum locations and can also be accessed online under Visitor Information.
GTC – Tourism and B2B
1. Validity of the General Terms and Conditions
- 1.1 These General Terms and Conditions (GTC) apply to all Museums that form part of the Museen der Stadt Wien. The term “Wien Museum” (hereinafter: „Museum”) covers all locations.
- 1.2 These General Terms and Conditions (GTC) govern all contracts concluded between the Museum and business customers. This includes licensed travel agencies or licensed tourist guides, hotels or companies with a tourism focus and a corresponding business license (hereinafter: "business customers"). Upon request, the business customer must provide the Museum with appropriate proof.
- 1.3 A business account agreement (see point 2.) may only be concluded with business customers.
- 1.4 Business clients undertake to employ tourist guides only who have a business license that is valid in Austria. Proof of this authorization must be provided upon request.
- 1.5 Terms and conditions of business clients do not apply.
2. Framework agreement (business account agreement for the use of the online reservation platform)
- 2.1 In order to use the Museum's online reservation platform, it is necessary to conclude a framework agreement (business account agreement) in addition to these GTC.
- 2.2 After concluding the framework agreement, business customers will receive a customer number and a link to create a password to use the online reservation platform. The password and customer number must be kept safe and may not be passed on to third parties.
3. Reservations
- 3.1 Business clients can make reservation requests not only in writing via e-mail to tourismus@wienmuseum.at, but also via telephone on weekdays from 09:00-15:00. Reservations via the Museum's online reservation platform require the prior conclusion of a business account agreement (point 2.).
- 3.3 The respective contract is concluded either by the binding booking of an appointment via the online reservation platform or, in case of a reservation request by telephone or e-mail and by providing the customer number, only upon written confirmation by the Museum. After successfully booking a reservation, business clients will receive a corresponding confirmation from the Museum with all information on the booking, expected costs and cancellation conditions.
- 3.4 For special offers, i.e. guided tours outside of regular opening hours or other guided tours not listed on the reservation platform (such as curator tours, themed tours, workshops, etc.), reservations can only be made on request and subject to availability by emailing to tourismus@wienmuseum.at. Reservations for special offers are allocated one month before the date.
- 3.5. Reservation requests for the permanent exhibition at the Karlsplatz location are charged at € 1,- per person (excluding any guide) (see below for cancellation options). A confirmed reservation at this location increases the undivided admission probability of an external group.
4. Cancellation conditions
- 4.1 Booked reservations can be cancelled free of charge, provided that the cancellation can be proven to have reached the Museum at least seven days before the reserved visit time via the online reservation platform, telephone or e-mail.
- 4.2 In the event of late or missing cancelations, the business customer will be charged a cancellation fee of € 50,- (or, as regards the Karlsplatz location with free admission, the reservation costs estimated in the reservation confirmation) at the end of the reservation date.
- 4.3 Reservations for special offers (point 3.4) can be cancelled free of charge up to one week before the date. In the event of late or missing cancelation of special offers, cancellation costs of at least € 250,- will be charged. If the previous organizational and administrative expenses are higher than usual, a higher amount will be charged.
- 4.4 The fees listed in points 4.2 and 4.3 are invoiced separately and cannot be offset against other fees.
5. Collection and on-site adjustments
- 5.1 Reserved tickets will be issued only to persons who have a corresponding authorization from the business customer or who have been named by the business customer and who provide the reservation number.
- 5.2 Changes to the reservation, i.e. minor on-site adjustments to the actual number of participants or admission prices to be paid, can be made in accordance with the cancellation conditions at the latest when the tickets are collected.
- 5.3 On-site adjustments regarding reservations for the free Karlsplatz location are not possible.
6. Invoicing
- 6.1 The Wien Museum invoices the vouchers on a monthly basis. Business customers may lodge an objection to the invoice within seven days from receipt. After seven days, the invoice is deemed to be accepted.
- 6.2 An invoice sent to the business client must be paid within 14 days.
7. Price
- 7.1 The admission prices correspond with the information provided on the Wien Museum website.
- 7.2 Qualified tour guides receive free admission.
8. Payment
- 8.1 The prices stated for all services include legally applicable taxes.
- 8.2 The total cost is shown before a binding reservation is made.
- 8.3 Invoices are payable without deduction within the period stated on the invoice. In the event of culpable default of payment, interest on late payments shall be 9.2% above the base interest rate. The Museum shall be entitled to claim damages caused by business customers, in particular the necessary costs of appropriate extrajudicial collection or recovery measures, insofar as these are in reasonable proportion to the claim being pursued.
- 8.4 In the event of repeated default of payment, the Museum reserves the right to block business customers and to cancel all future reservations already made by business customers. In this case, the Museum may terminate the framework agreement without observing a notice period.
- 8.5 Offsetting of claims against the Museum is fundamentally excluded.
9. Disruptions to services and compensation
- 9.1 The Museum shall not be liable for delays or impossibility of performance due to force majeure (e.g. strike, fire, war, theft, etc.) or for reasons beyond the Museum's control.
- 9.2 The Museum shall be liable for delay or impossibility of performance for reasons other than those stated in point 9.1, provided that at least gross negligence is given.
- 9.3 The Museum shall only be liable for material damage caused by business partners to the extent that it or one of its agents is guilty of intent or gross negligence.
10. Contract duration and termination
- 10.1 Unless agreed otherwise, the framework contract is concluded for an indefinite period of time.
- 10.2 The Museum may terminate the framework agreement without prior notice in the event of repeated default of payment by business clients (Section 8.4).
- 10.3 If the business client's concession expires, he must inform the Museum without undue delay and may no longer make reservations. In this case, the Museum may terminate the framework agreement without observing a period of notice.
- 10.4 Both contracting parties may terminate the framework agreement in writing without stating reasons, subject to a three-month notice period to the end of each calendar month.
11. Final provisions
- 11.1 The place of fulfilment for all services arising from this contract is Vienna.
- 11.2 If individual provisions of these GTC are declared to be invalid or ineffective, the effectiveness of the other provisions remains unchanged.
- 11.3 Any legal disputes arising from this contract are exclusively subject to Austrian law. The application of UN Purchasing Rights, the referral provisions of the IPRG and Regulation (EC) No. 593/2008 of the European Parliament and of the Council of June 17, 2008 on the law applicable to contractual obligations (Rome I) is excluded.
- 11.4 Any changes or additions to these GTC are only effective if made in writing.

GTC – Rental of Spaces for Events
1. Validity of these General Terms and Conditions
- 1.1 These General Terms and Conditions (GTC) apply to all museums that form part of the Museen der Stadt Wien. The term Wien Museum covers all loca-tions.
- 1.2 These General Terms and Conditions (GTC) govern the contractual terms and conditions between the Wien Museum and its clients (hereafter referred to as the “Contractual Partners” or “Renters”) for the temporary renting of spaces, areas, and furniture (hereafter referred to as the “Contractual Object” or “Rental Object”) and for services provided by the Wien Museum in the context of events.
- 1.3 Any general terms and conditions of the Contractual Partners do not apply.
2. Conclusion of the contract
- 2.1 As part of a booking request, the potential Contractual Partner informs the Wien Museum about the concrete events space, the time, the purpose of the rental, and any special wishes.
- 2.2 On the basis of this booking request, the Wien Museum makes an offer to the Contractual Partner including all the costs, services, payment conditions, and cancellation fees. The rental fee given in the offer includes the handing over of the offered spaces for the agreed duration of the rental.
- 2.3 The legally binding acceptance of the offer and, thereby, the contract comes into effect when the offer is signed by the Contractual Partner and returned.
- 2.4 The Wien Museum grants the potential Contractual Partner a period of two weeks to consider the offer. If the Wien Museum receives a delayed response from the potential Contractual Partner after these two weeks have expired, this response is regarded as a new offer that requires acceptance by the Wien Museum.
- 2.5 During this period of two weeks for considering the offer, the Wien Museum will not give the space to other interested parties.
3. General conditions of use
- 3.1 The Rental Objects of the Wien Museum may only be used by those entitled to do so for the agreed period and purpose and in line with the following condi-tions of use.
- 3.2 The Contractual Object is to be treated as designated, with due care, and in line with the intended purpose and is to be returned after the end of the contract in the same condition as before the rental. If the Renter or their representative made no complaints upon the handing over of the Rental Object, it is regarded as having been handed over in a perfect condition.
- 3.3 The rental period may not be exceeded. The Renter is obliged to return the Rental Object on time and in line with the agreed rental period.
- 3.4 Events may only take place as prescribed in the contract. The instructions of the staff of the Wien Museum must be followed. For the duration of the event, em-ployees of the Wien Museum or persons specified by the Wien Museum may be present in order to monitor compliance with the use conditions. In the event of inappropriate use, these persons are permitted to produce photographic and video material.
- 3.5 During the use of the space, the Contractual Partner must ensure that they themselves or an authorized representative is present at all times, can be con-tacted, and has the authority to receive instructions or declarations from the Wien Museum. If the Wien Museum is unable to contact this responsible per-son, it has the right to take measures to avert any sort of risk and to do so at the expense of the Contractual Partner.
- 3.6 Objects brought by the Renter that are commonly used at events (high tables, chairs, lecterns, etc.) are to set up by the Renter at an agreed time and complete-ly removed after the event. If these objects are not removed by the agreed dead-line, the Wien Museum has the right to have them removed at the expense and risk of the Contractual Partner. The Contractual Partner is exclusively liable for objects of all sorts brought into the Rental Object.
- 3.7 In addition to the conditions set out in Item 3.6, technical equipment and devic-es can only be used with the prior agreement of the Wien Museum. This re-quirement does not apply to laptops and beamers.
- 3.8 If the sound system is organized via and makes use of the in-house equipment, the provisions of Item 10 apply.
- 3.9 Photographic, video, and sound recordings can only be made with the prior approval of the Wien Museum.
- 3.10 In addition to the provisions of Item 3.6, the temporary fixing of decorations, advertising material, etc., is only permitted with the prior approval of the Wien Museum. Long-term changes to the event spaces (the creation of nail or drill holes, etc.) are fundamentally prohibited.
- 3.11 The Contractual Partner is obliged to inform the Wien Museum about all third-party companies connected with the event at least 2 weeks before the start of the event. The Wien Museum has the right to reject any third-party companies that it considers unsuitable for delivering a specific service.
- 3.12 Noise emissions are to be reduced to an acceptable level of 80 decibels and 55 decibels in the external spaces.
- 3.13 Should the Rental Object be used during the night, the Contractual Partner commits themselves to observe the curfew – e.g. to avoid any unnecessary noisemaking – between 10 p.m. and 7 a.m. If the Wien Museum suffers adverse consequences due to any failure to observe this curfew, the Contractual Partner is exclusively liable.
- 3.14 The Rental Partner commits themselves to observing the Museum Rules and the fire regulations. Circulation spaces, emergency exits, escape routes, the emergency lighting, and fire alarms and extinguishers, etc., may be neither blocked nor covered.
- 3.15 The use of fireworks or open flames is prohibited.
- 3.16 The use of smoke machines or similar devices is prohibited.
- 3.17 If the fire alarm is unnecessarily triggered as a result of the culpable behavior of a person attributable to the Renter (e.g. a visitor, technician, etc.) any result-ing costs (of the deployment of the fire brigade, etc.) are to be borne by the Renter.
- 3.18 The Renter is obliged to remove any waste produced during the rental period. Otherwise, this waste will be removed at the cost of the Contractual Partner.
- 3.19 Access is exclusively permitted to the rented spaces and areas.
- 3.20 The Contractual Partner assumes responsibility for ensuring that only the max-imum number of people permitted by the authorities gain access to the event.
- 3.21 Smoking is prohibited in all spaces.
- 3.22 The distribution or sale of goods, food, or drink is only permitted with the pri-or agreement of the Wien Museum.
- 3.23 Animals may only be brought into the museum with the prior agreement of the Wien Museum.
- 3.24 The Renter commits themselves to removing from the rented spaces all persons who contravene these use conditions.
- 3.25 The Renter must give the Wien Museum detailed written information about the type and the organization of the event at least 4 weeks before the realization of the event.
4. Payment conditions
- 4.1 After the successful conclusion of the contract, the Contractual Partner has to pay a deposit of 50 % of the total agreed contractual sum within one month.
- 4.2 After the event, the Wien Museum will present a final invoice for the entire ser-vice. The invoiced amount is to be paid within a month of the delivery of this invoice.
5. Cancellation conditions
- 5.1 If the Contractual Partner announces that, contrary to the contract, they will not make use of the Rental Object and, hence, wish to withdraw from the contract, they must pay the following cancellation fee:
- Up to 6 weeks before the start of the rental of the object, 50 % of the agreed contract sum (plus VAT) is due for payment.
- Up to 4 weeks before the start of the rental of the object, 75 % of the agreed contract sum (plus VAT) is due for payment.
- From 4 weeks before the start of the rental of the object, 100 % of the agreed contract sum (plus VAT) is due for payment. - 5.2 In addition to this, all expenses already incurred by the Wien Museum are to be remunerated.
6. Right to cancellation of the Wien Museum
- 6.1 The Wien Museum has the right to cancel the contract or the presented offer without notice, if:
- the Renter is more than 30 days in arrears with payments related to other contracts with the Wien Museum,
- the Wien Museum becomes aware that the event planned by the Contractual Partner violates legal provisions or could be reasonably expected to lead to a breach of the peace or a threat to safety or public order,
- the Contractual Partner has given incorrect information regarding the type, execution, or purpose of the event,
- any statutory approvals have not been presented on schedule, or
- the Contractual Partner infringes the provisions set out in these GTC.
7. Liability
- 7.1 If the Renter or their representative made no complaints upon the handing over of the Rental Object, it is regarded as having been handed over in a perfect condition. If defects are apparent to the Contractual Partner during this handover, these are to be minuted. New damage is to be reported to the Wien Museum immediately.
- 7.2 The Contractual Partner bears the entire risk for the preparation, setting up, execution, and dismantling of the event. The Contractual Partner is liable for all damage and consequential damage caused by themselves, persons commis-sioned or employed by them, or visitors to and guests at their event, regardless of who suffered as a result of this damage.
- 7.3 If employees of the Wien Museum provide support as a matter of courtesy but beyond their contractual obligations, these actions are ascribed to the Contrac-tual Partner.
- 7.4 Any repair costs that are caused by the Contractual Partner, their contractors, employees, or visitors will be added to the final invoice. And any resulting im-provements or repairs will be executed or commissioned by the Wien Museum.
- 7.5 The Wien Museum is only liable for deliberate and grossly negligent material damage.
8. Insurance
- 8.1 The Contractual Partner must take out property and personal insurance at their own expense. A copy of the policy is to be presented to the Wien Museum by the deadline stipulated in the contract.
9. Catering
- 9.1 Gastronomic support is principally provided to the Wien Museum by GMS GOURMET GmbH, unless agreed otherwise. If the Contractual Partner com-missions an external caterer with the prior agreement of the Wien Museum, this company must adhere to the event guidelines of the Wien Museum.
10. Sound system
- 10.1 In order to be able to use the in-house sound system a sound technician fixed fee must be paid. The use and setting up and dismantling of any additional equipment must be agreed separately with the sound technician.
- 10.2 If the Contractual Partner uses their own sound technician, a sound technician fixed fee will be invoiced to cover the costs of the handover and instructions.
11. Statutory approvals
- 11.1 All designated statutory approvals and notifications for the planned event are to be obtained by the Contractual Partner at their own expense and presented to the Wien Museum by the deadline stipulated in the contract.
- 11.2 If the statutory approvals and notifications are not presented to the Wien Museum by the deadline stipulated in the contract, the Wien Museum has the right to unilaterally cancel the contract (see Item 6.1).
12. Special conditions for the location “Wien Museum”
- 12.1 The following conditions apply exclusively to the rental of the Wien Museum, 1040 Vienna, Karlsplatz.
- 12.2 The entire 3rd floor may be used by a maximum of 300 persons simultaneously.
13. Special conditions for the location “Hermesvilla”
- 13.1 The following conditions apply exclusively to the rental of the Hermesvilla, 1130 Vienna, Lainzer Tiergarten.
- 13.2 The Tilgnersaal may be used by a maximum of 100 persons simultaneously.
- 13.3 No food or drink of any sort may be consumed in the Tilgnersaal.
- 13.4 The scattering of exclusively silk or paper flowers is permitted inside the Hermesvilla. This and the scattering of rice or flowers are prohibited in front of the Hermesvilla.
14. Special conditions for the location “Otto Wagner Kirche am Steinhof”
- 14.1 The following conditions apply exclusively to the rental of the Otto Wagner Kirche am Steinhof, 1140 Vienna, Baumgartner Höhe 1.
- 14.2 A maximum of 199 persons is permitted to participate in events in the Otto Wagner Kirche am Steinhof. This does not apply to private events such as weddings or baptisms.
- 14.3 No food or drink of any sort may be consumed in the Otto Wagner Kirche am Steinhof.
- 14.4 There is no catering partner for the location at the Otto Wagner Kirche am Steinhof. The name of such a partner must be communicated at least 2 months before the event.
- 14.5 A request must be made to Wiener Standortentwicklung GmbH at wse@wse.at for the use of the external area around the church.
- 14.6 The scattering of any objects (rice, flower petals, etc.) is prohibited for the entire location.
15. Final provisions
- 15.1 The jurisdiction for all the services covered by this contract is Vienna.
- 15.2 If any individual provisions of these GTC are declared to be invalid or ineffective, the effectiveness of the other provisions remains unchanged.
- 15.3 Any legal disputes arising from this contract are exclusively subject to Austrian law. The application of UN Purchasing Rights and the reference norms of the IPRG and of VO (EG) No. 593/2008 of the European Parliament and Council of 17th June 2008 to the law applicable to contractual obligations (Rome I Regulation) is excluded.
- 15.4 Any changes or additions to these GTC are only effective if made in writing.
